Rep. Edolphus Towns (D-N.Y.), chairman of the House Oversight and Government Reform Committee, which grilled top Toyota officials on Wednesday, said in a statement that the documents, which were obtained under subpoena from a former Toyota lawyer-turned-whistleblower, “indicate a systematic disregard for the law and routine violation of court discovery orders in litigation.”

The committee subpoenaed documents held by former top Toyota North America lawyer Dimitrios Biller. From 2003 to 2007, Biller represented Toyota against liability claims of Toyota drivers who were injured in crashes. Biller said that the documents showed that Toyota refused to release documents it legally was required to turn over, because they would have allowed the cases against Toyota to go forward.

The documents include Biller’s recounting of a 2006 arbitration case against Toyota involving a vehicle rollover that left the driver paralyzed. Toyota was willing to pay a premium settlement to prevent the plaintiff’s lawyers from getting access to Toyota’s Books of Knowledge, which, Biller writes, “contain highly sensitive information that rises to the level of trade secrets and highly confidential information.”

In the documents, Biller explains: “The Books of Knowledge contain information on how to design vehicles and component parts (including safety systems like seat belts, side curtain airbags). The information does not relate to any one particular vehicle; the information relates to all vehicles. The information is essentially design principles and philosophies that serve the foundation for how Toyota designs its vehicles.”

Toyota did not respond to a request for comment.

Sales of previously owned homes in January stumbled considerably for the second consecutive month. The National Assn. of Realtors in Washington said Friday that sales fell 7.2%.

January sales were the lowest since June but 11.5% higher than in January 2009.

Previously owned homes make up the bulk of the nation’s buying activity. Economists said that last month’s sales drop from December was another sign the market is critically weak and unlikely to recover robustly this year as the potential for more foreclosures looms.

Friday’s report follows news this week that sales of newly built homes hit a record low in January and that mortgage applications plunged to their lowest level in nearly 13 years.

The poor-sales data on all these fronts indicated that Congress’ attempt to stimulate the market by extending and expanding a home-buying tax credit through April was having little to no effect on consumer sentiment, economists said.

The credit was extended in November as it neared its expiration and buyers were flooding the market, boosting sales.

“The tax credit wore off,” said economist Christopher Thornberg, a principal with Beacon Economics in Los Angeles. “Now that the tax credit has been extended, it is no longer functional.

“We will get a push close to the end of it, probably in March.”

He said sales could plunge after the tax credit expires April 30.

The Realtors group’s data are based on its proprietary multiple listing service. The group reports an annual sales pace every month that is adjusted to take into account seasonable variations.

Last month’s sales pace was 5.05 million units for the year, the Realtors group said, meaning that many units would be sold if January’s rate carried through for the rest of the year.

The dour housing news came as the government reported that the U.S. economy grew at a slightly faster pace in the final three months of 2009 than estimated.

Gross domestic product rose at an annual rate of 5.9% in the fourth quarter, according to the U.S. Commerce Department. That was up 0.2% from the previous estimate reported by the department.

Private inventory investments, exports, personal consumption expenditures and nonresidential fixed investment were the biggest contributors to that growth, even as imports increased.

Most of that growth was related to business inventory restocking, a temporary factor that is expected to fade in the coming months.

In the Realtors group’s report, the number of existing homes for sale at the end of January fell 0.5% to 3.27 million. That represents a 7.8-month supply at the current sales pace, up from a 7.2-month supply in December. Raw inventory is at its lowest level since March 2006.

Washington policymakers have taken several measures to support the housing market, keeping interest rates low and insuring mortgages for many buyers through the Federal Housing Administration. Last year the Obama administration launched a $75-billion effort to reduce mortgage payments for troubled borrowers, though that program has struggled to make mortgage relief permanent.

Foreclosure properties and other distressed homes remain a big part of the market, accounting for 38% of sales last month and contributing to a drop in prices. The national median price was $164,700 in January, an 8% decline from $178,300 in December, but unchanged from a year earlier.

“For people trying to sell their homes, they are going to be competing with distressed home sales,” said Celia Chen, a housing economist with Moody’s Economy.com. “In order to really understand or predict when the housing market will recover we need to have a good handle on when foreclosures are going to hit the market, and I think there is a lot of uncertainty around that.”

Regionally, previously owned home sales fell 5.2% in the West, 7.4% in the South, 6.9% in the Midwest and 10.9% in the Northeast.

Political commentators are warning the decision to seize more than $1 billion belonging to Thailand’s former prime minister might precipitate a ‘final showdown’ between his red shirt supporters and the yellow shirts who support the army and the monarchy.

Thailand’s Supreme Court had prepared for the trial for weeks and the interest in it was so high that the entire seven-hour verdict was broadcast live on television.

Thaksin Shinawatra still has many supporters in Thailand, and as the decision was read out his red shirt supporters were seen crying on television.

An extra 20,000 security personnel have poured into Bangkok in recent weeks in the expectation it would provoke riots.

On the one hand the decision legitimises the army’s decision to stage the 2006 coup on the grounds Mr Thaksin was corrupt, while letting him keep the assets he earned prior to becoming prime minister.

Pavin Chachawanpunpang, from the Institute of South East Asian Studies, says the verdict was seen as something of a compromise.

“Thaksin has always claimed that prior to becoming prime minister for 2001 all the assets and the money he earned honestly, so this portion of money Thaksin says that the court should not take it away,” he said.

“So it’s a good decision for the court, but obviously because of the military coup in 2006 they had to find some kind of justification.”
Violence to come

Suni Phu Sook, another experienced analyst of Thai politics, believes the decision will anger Mr Thaksin’s supporters as well as his enemy yellow shirts.

“The yellow shirts and those who supported the overthrow of Thaksin wouldn’t be very happy with that decision that compromised the aim to cripple Thaksin’s wealth,” he said.

“On the other hand for the red shirts, the decision to give back assets to Thaksin will embolden them.”

Mr Suni believes the decision may force a final confrontation between the millions in Thailand who still support Mr Thaksin and the yellow shirts.

“It may be the first step of a final showdown in Thai politics; [which has] been left unfinished since the coup in 2006,” he said.

While there was no violence on the streets of Bangkok as the decision was read out, many are concerned about what the coming weeks will bring.

Mr Suni is concerned radical elements may try and provoke violence.

“It is not at all reassuring when we see those who claim themselves to be leaders of the hardcore red shirts going public with the boast that they have been training military wings, they have been providing military expertise to the network, they have been gaining access to weapons,” he said.

“And they are calling for their members for example to bring now a million bottles of gasoline to Bangkok.”

For his part, Mr Thaksin responded to the verdict from Dubai, where he is hiding out from Thai authorities.

He swore that he would die within seven days if it were true he gained his assets illegally and urged his supporters to keep on fighting.

KABUL — A crew of suicide bombers armed with grenades and Kalashnikov rifles attacked two guesthouses frequented by foreigners here early Friday, setting off a gun battle with Afghan police and killing at least 16 people.

The Taliban asserted responsibility for the dramatic raid in central Kabul, which began around daybreak and wounded at least 38 people. The assault was the latest in a string of attacks to rock the Afghan capital, whose residents generally feel a world away from the raging rural insurgency that thousands of U.S.-led troops are seeking to contain in a new push in southern Afghanistan.

The attack further eroded the sense of security in the capital, challenging the government of President Hamid Karzai. It came about five weeks after a similar commando-style assault on a shopping center near the presidential palace and a large hotel.

“If we have security, why do we have this kind of drama?” asked Ahmad Haji Zada, 22, as he surveyed the damage to his mangled building-materials store, about a block from the two small hotels. “How is it possible for them to get into the city?”

The siege also seemed sure to raise tensions between two of Afghanistan’s neighbors, India and Pakistan, longtime foes whose foreign secretaries resumed peace talks Thursday in New Delhi. Indian and Afghan government statements said many guests in the facilities bombed Friday were Indian citizens, suggesting they were the targets.

Pakistan opposes India’s rising influence in Afghanistan, and U.S. and Indian officials have accused Pakistan’s military intelligence service of collaborating with Afghan militants to bomb the Indian Embassy in Kabul in 2008. Pakistan has denied the allegation.
