Tilikum known as dangerous whale at SeaWorld Orlando

SeaWorld Orlando has always known that Tilikum, a 12,000-pound orca that killed trainer Dawn Brancheau on Wednesday, could be a particularly dangerous killer whale.

SeaWorld trainers were forbidden from swimming with Tilikum, as they often did with the resort’s seven other orcas.

Only about a dozen of 28 handlers, including Brancheau, had been specifically trained to work with him from the edge of SeaWorld’s pools.

That was in part because of his size: At an average weight of nearly 6 tons, Tilikum — nicknamed Tilly — was the largest orca at any of SeaWorld’s parks.

But it was also because of his ominous history.

In 1991, Tilikum and two female killer whales dragged trainer Keltie Byrne underwater, drowning her in front of spectators at Sealand of the Pacific, a defunct aquarium in Victoria, British Columbia.

Acquired by SeaWorld the next year to breed with female orcas, he was involved in a second incident in July 1999 when the naked body of a man who had apparently sneaked into SeaWorld after hours to swim with the whales was found draped dead across his back.

Authorities later concluded that the man, Daniel Dukes, likely suffered hypothermia in the 55-degree water and drowned, but they said it also appeared Tilikum bit the man’s body and tore off his swimming trunks after he had died.

Still, Chuck Tompkins, the corporate curator in charge of animal behavior for SeaWorld Parks & Entertainment, said Tilikum was not an unusually violent orca.

“What you need to remember is, we’ve done thousands of interactions with this animal with no incidents whatsoever,” Tompkins told the Orlando Sentinel. He also noted that Tilikum had fathered many calves at SeaWorld, calling him “a valuable asset not only from a breeding standpoint but from a behavior standpoint, too.”

Obama Rejects Advice to Shrink Health Proposal

WASHINGTON—President Barack Obama’s health-care proposal is a victory for those in the White House who want to press ahead with ambitious legislation over those who counseled scaling it back.

The proposal, unveiled Monday, reaffirmed Mr. Obama’s support for the policy’s sweeping objectives: expanding health-care coverage to some 30 million Americans, new efforts to control health spending and new rules for health insurers.

Continued pursuit of a comprehensive health-care overhaul had been uncertain following the victory last month of Republican Scott Brown in the Massachusetts U.S. Senate election. Mr. Brown won partly by campaigning against the health bill, which was proving increasingly unpopular with voters.

“People were in shell shock after Massachusetts,” said one person close to the White House deliberations.

Advocates of a “skinny bill,” including White House Chief of Staff Rahm Emanuel, made headway after that defeat, according to people involved in the discussions. This camp argued for a slimmer measure that would include provisions from the pending Democratic legislation—such as forcing insurers to cover pre-existing conditions—in a bid to attract Republican support or reduce the risks if Democrats pushed it through Congress on their own.

Mr. Obama himself publicly suggested such a step. A day after the Massachusetts election, he signaled he might support a smaller measure. “I would advise that we try to move quickly to coalesce around those elements in the package that people agree on,” Mr. Obama told ABC News.

Mr. Emanuel, who had long advocated for a smaller health-care bill, argued that the state of play in Congress did not favor the Democrats’ sweeping legislation, which was helping drive down Mr. Obama’s approval ratings, one person involved in the talks said.

“Rahm strongly believes that incremental reform is all that can (and should) be done,” this person said in an email Monday.

White House senior adviser David Axelrod led the counterargument, according to Democrats familiar with the debate. He saw the Obama legacy as intertwined with revamping health care and didn’t relent after Massachusetts.

The president explored a scaled-back approach and asked his staff to examine areas of broad political agreement, according to congressional aides involved in the process. The exercise quickly pointed to a practical problem: You could not make incremental changes that were politically popular without pursuing the whole package.

For instance, Republicans and Democrats agree they should prevent insurers from denying coverage based on pre-existing conditions. But without a mandate requiring healthy people to buy coverage, insurers would wind up with a slew of sick customers without healthy ones to balance them out. That would likely lead to either soaring premiums or a bankrupt industry.

After a series of conference calls and meetings, the White House was left with a list of policies that looked very similar to the House and Senate bills. “The practical problems all lead back to themselves,” one knowledgeable Democrat familiar with the debate said.

White House aides say Mr. Obama tipped his hand at a town-hall meeting Jan. 22 in Elyria, Ohio, when he discussed the results of trying to tease out insurance regulations. “A lot of these insurance reforms are connected to some other things we have to do to make sure that everybody has some access to coverage.”

Despite Mr. Obama’s resolve, the White House may still wind up supporting a scaled-back bill if congressional Democrats are unable to rally enough support for the comprehensive measure. Aides left the door open to that approach.

Inside the White House, the calculations involved both politics and policy. “There is a growing realization that we are still so very close,” one person involved in the talks said Monday. “Today was a big victory for the comprehensive advocates.”

42 Dead as Teams Search Flooded Madeira

FUNCHAL, Portugal (AP) — Rescue workers dug through heaps of mud, boulders and debris on Sunday on the Portuguese island of Madeira, searching for victims buried by flash floods and mudslides that had already killed at least 42 people in the popular tourist area.

More than 120 others were injured and an unknown number were missing, possibly swept away or smothered, the authorities said, adding that the death toll could still rise. About 250 people were forced to flee their homes and go to shelters.

The storm was the worst to hit Madeira, an island in the Atlantic off northwest Africa, since 1993. It lashed the capital, Funchal, on Saturday and turned some streets into raging torrents of liquid brown mud, water and debris.

“We heard a very loud noise, like rolling thunder,” said Simon Burgbage of Britain. “The ground shook, and then we realized it was water coming down.”

The flash floods were so powerful they carved paths down mountains and through the city, churning under bridges and even tearing some down. Residents had to cling to railings to avoid being swept away. Cars were consumed by the force of the water, and the streets were littered with the battered shells of overturned vehicles that had been swept downstream.

“It was horrible,” said Andreas Hoisser, a German tourist. “There were cars on rooftops, there were vans and trucks that had fallen and been totally crushed.”

The water swept even a heavy fire truck downstream, slamming it into a tree.

The death toll “will likely increase, given the circumstances of this flood,” said Francisco Ramos, a regional social services spokesman. He added that there were still “great difficulties” with communications on the island because phone lines had been ripped out by the deluge.

Firefighters used pumping equipment to try to drain an underground parking garage at a downtown department store close to where the flooding was heaviest. The local authorities feared that shoppers might have been trapped below ground.

“The store is totally destroyed, damaged, full of slurry,” said the owner, João Andrade.

A medical team backed up by divers and rescue experts arrived Sunday on Madeira, the main island in an archipelago of the same name about 550 miles southwest of Lisbon. The plane was also carrying telecommunications equipment.

20,000 Jobs Lost in January as Jobless Rate Falls to 9.7%

The United States economy shed 20,000 jobs in January, the government said Friday, deepening concern that relief from the deepest economic downturn in a generation would be slow to come. But even as the economy struggled to start creating jobs again, the unemployment rate fell to 9.7 percent from 10 percent in December.

As the broader economy gains steam and crucial sectors like manufacturing spring back to life, analysts say the recovery appears to be intact. But the nation’s stubbornly high unemployment rate remains a persistent thorn in the side of optimists, and economists expect the situation to worsen before it gets better.

Some forecasts call for the jobless rate to reach nearly 11 percent by year’s end, which would significantly dampen spending by consumers, a critical driver of growth. That has prompted concern that the economy could enter a painful period of slow growth or even fall into another downturn.

“We are turning the corner,” an economist for IHS Global Insight, Nigel Gault, said. “But the gains will probably not be big enough to make serious inroads into the unemployment rate for some time.””

The manufacturing sector showed signs of relief, adding jobs for the first time since the onset of the recession in 2007. Construction continued to suffer, as businesses grappled with a crisis in the commercial real estate market. Temporary jobs increased, a sign that employers were tentatively beginning to expand their ranks.

In its report, the government revised its job loss numbers for November, saying the economy gained 64,000 in that month rather than 4,000. But the numbers in December were much worse than previously stated; the economy lost 150,000 jobs rather than the 85,000 originally reported.

The overall toll of the recession, meanwhile, grew larger: 8.4 million jobs have been lost since December 2007, the government said, nearly one million more than previously recorded. Those numbers jumped significantly from December because the Labor Department on Friday said it had completed a benchmark revision of job losses since April 2008. Job losses in August, September and October of last year were 240,000 worse than original forecasts.

Economists said the declining unemployment rate was probably a statistical quirk and did not indicate the start of a downward trend. The unemployment rate is determined based on interviews with a random sample of Americans, and its results can be erratic. The monthly tally of job losses is considered a more reliable snapshot of the economy because it incorporates data from a large number of businesses.

The dissonance between the tepid recovery for the jobs market and robust turnaround for Wall Street has exacerbated populist tensions.

President Obama has sought to persuade the public that his priority is jobs creation, announcing a series of efforts in recent weeks aimed at clamping down on banks and jump-starting the labor market. On Tuesday, Mr. Obama proposed using $30 billion of repaid bailout loans to help community banks increase lending to small businesses.

Many business owners continue to complain that strict lending standards are hampering their access to funds that would allow them to expand.

Kirk K. Meurer, the owner of store in Cleveland that provides furniture to businesses, has frozen the pay of his 30 employees and stopped buying new cars in an effort to trim costs. He has a $250,000 loan, but he said it has been difficult to persuade his bank to lend any more.

“I’m being very frugal with my decisions,” Mr. Meurer said. “For us to hire, we need to see a turn in the economy.”

Many more Americans, even those with jobs, are feeling the pinch. The underemployment rate, which counts people who have given up looking for work and those who are working part-time because of a lack of full-time positions, has steadily risen over the past year. In January, it touched 16.5 percent.

Obama: Health care is not dead

The proposal for Fiscal Year 2011 includes a “reserve fund for health care reform” totaling $634 billion — a “down payment,” as the administration also puts it.

Of course, the administration has little choice but to budget for health care legislation. Failure to do so would be a sign it has given up on the idea, and Obama has made it clear he will continue pushing for a final bill.

“What I will not do is stop working on this issue,” Obama said yesterday at his town hall in Nashua, N.H. “Because it is the right thing to do for America and you need to let your members of Congress know they shouldn’t give up, they should keep on pushing to make it happen.”

Obama will also discuss health care strategy this morning during his meeting with Senate Democrats.

Budget director Peter Orszag pointed out that both the House and the Senate have passed health care bills, and are now trying top merge — an effort thrown off track by the recent Senate election in Massachusetts.

 

 

Scott Brown’s win gives Republicans the power to block a final health care bill in the Senate. Obama has responded by trying to pressure congressional Republicans into offering their own plans, lest they risk the wrath of voters who want changes in the health care system.

“What I’ve done is I’ve said to the Republicans, ’show me what you’ve got,’” Obama said in New Hampshire.

Bill ending banks’ role in student loans stalls in Senate

Four months after it sailed through the Democratic-led House, legislation to overhaul federal student lending and channel about $80 billion in savings toward an array of education initiatives has stalled in the Senate.

In his State of the Union address Wednesday, President Obama exhorted the Senate to pass the bill, which he said would revitalize community colleges and make college more affordable. But the bill faces unified opposition from the Republican minority and sharp questions from at least some Democrats, according to congressional aides from both parties, and the Democratic majority has put it on hold during the drawn-out health-care deliberations.

The assumption on Capitol Hill is that Democrats will attempt to move the student loan bill through a special procedure that requires a simple majority rather than the usual 60 votes out of 100 needed to stop a filibuster. That tactic is also under discussion for health-care reform, said the aides, who asked for anonymity to speak candidly. So the two issues have become intertwined.

Timing is significant. because the student loan legislation would require all colleges to use direct government lending as of July 1 for federal loans. Currently, they can choose between direct lending and a federal program that guarantees student loans made by private banks. The bill would not affect nonfederal loans.

By cutting banks out of the equation, the administration expects to reap $80 billion over the next decade for increased student aid, community colleges, early childhood education and other programs. Those funding estimates, however, are being questioned because they are several months old.

Prominent players in the lending industry, including Sallie Mae, oppose the legislation, saying that it will eliminate thousands of jobs and that there are ways to save the government money without shutting out private lenders. Republicans depict themselves as defenders of market competition.

Sen. Tom Harkin (D-Iowa), chairman of the Health, Education, Labor and Pensions Committee, has not introduced his version of the House bill, passed in mid-September on a vote of 253 to 171. He said he plans to move a bill “early this year.”

In the meantime, Republicans are on the attack. “Relying on budgetary gimmicks to stage another Washington takeover, this time of 15 million student loans, is not good for college students,” said Sen. Lamar Alexander (R-Tenn.), a former education secretary. “The Department of Education in Washington will not be able to serve students as well as 3,000 lending institutions.”

Sen. Ben Nelson (D-Neb.) and a few other Democrats also have raised questions about the bill, although it appears that most in the party support it.

Bob Shireman, deputy undersecretary of education, said colleges are preparing to switch to direct lending. “I’m confident that we’ll see movement on this bill.”

The University of Maryland is preparing to switch to direct lending if needed, said Sarah Bauder, the school’s financial aid director, but she added that she prefers the public-private guaranteed lending program. “My concern is that no one’s made a decision yet” in Congress, Bauder said. “It’s holding the students hostage.”

Scott Brown Victory a ‘Repudiation’ of Obama, Health Care?

In the wake of Republican Scott Brown’s stunning defeat of Democrat Martha Coakley in the race to replace the late Sen. Ted Kennedy of Massachusetts, the debate has begun about what the outcome means for President Obama and Democrats nationwide.

Brown won 52 percent of voters to Coakley’s 47 percent in Tuesday’s special Senate election. Coakley, the state attorney general, had a 30-point lead three months ago.

Republicans believe a win in the bluest of blue states, where a Republican had not been elected to the U.S. Senate since 1972, amounts to a popular rebuke of the president’s agenda.

“There’s been a pattern here that began last spring and the administration has refused to acknowledge what the people out across the country have been saying,” GOP chairman Michael Steele said on “Good Morning America” today.

Fresh row over UN move in Sri Lanka

Seventeen days ahead of the January 26 Presidential election, a fresh row has broken out between Sri Lanka and the United Nations (UN) after it was made known that the UN Secretary-General Ban ki-moon has conveyed to Colombo that he is considering appointing a Commission of Experts to advise him further and to assist the Sri Lankan Government in taking measures to address possible violations of international human rights and humanitarian law in the last days of Eelam War IV (July 2006 to May 2009).

A report posted on the UN news centre web site said that UN spokesman Martin Nesirky made the remarks in response to questions from media on the statement made in New York by Philip Alston on Thursday. The Special Rapporteur on extrajudicial, summary or arbitrary executions told a news conference that there are strong indications that the video of alleged extrajudicial executions by Sri Lankan soldiers that aired last August on British television is authentic and called for an inquiry into possible war crimes committed during the war between the Sri Lankan forces and the LTTE.

Responding sharply to the reports, President Mahinda Rajapaksa, who is seeking a second term two years ahead of his tenure, told a group of officials at a meeting in Matara district that the UN has to inform the Sri Lankan Government before issuing statements since Sri Lanka is also a member of the world body and is an independent country.

The developments could impact the outcome of the forthcoming Presidential polls, in which the contest is mainly between Mr. Rajapaksa and the common Opposition Sri Lanka Presidential candidate, retired General Sarath Fonseka, as charges of `war crimes’ has been the recurring theme within and outside the island nation since the military defeat of the LTTE in May 2009.

In a controversial interview to English weekly Sunday Leader on December 13 the commander turned politician had said brother of President and Defence Secretary Gotabhaya Rajapaksa had instructed a ground commander in the battle zone during the last phase of the Eelam War IV to shoot all LTTE leaders who came out to surrender to the military. But the next day, the General went back on his comments.

Gen. (retd.) Fonseka who got the backing of the post-Prabakaran Tamil National Alliance (TNA) in support of his candidature earlier this week on Friday got endorsement from unexpected quarters with the announcement by Batticaloa Mayor Sivageetha Prabakaran that she would vote and work for his victory. Ms. Prabakaran was a member of the break-away LTTE, Tamil Makkal Viduthalai Pulikal (TMVP) and a camp follower of the group founder Karuna.

`Col’ Karuna is currently a Minister in the Rajapaksa Government and is one of the Senior Vice-Presidents of the ruling Sri Lanka Freedom Party (SLFP). The Batticoloa Mayor too joined the SLFP in the footsteps of `Col’ Karuna. He was not available for comment on the latest developments.

The fast paced developments in the run up to the Presidential poll has undoubtedly made it a tough fight for the incumbent President since both the chief contenders for the top office not only represent the majority Sinhalese community but are also credited for the successful military campaign against the Tamil Tigers. At the UN headquarters the world body spokesperson Martin Nesirky told reporters that the establishment of a commission of experts to advice Mr. Banki-Moon on Sri Lanka is currently receiving detailed consideration by the UN Secretariat.

Responding to questions on comments made on Thursday by the Special Rapporteur dealing with Sri Lanka, Philip Alston, and the Spokesperson said that the Technical Note presented by the Special Rapporteur highlights the need for a credible, independent and impartial investigation of the allegations of violations of human rights and international law by all sides in the conflict in Sri Lanka.

Separately at his news conference Mr. Alston maintained that the Office of the High Commissioner for Human Rights has repeatedly called for a full, broad, and impartial investigation into allegations of violations of human rights and international law by all sides that occurred during the civil war in Sri Lanka. “A full and impartial investigation into allegations of human rights violations is critical if we are to confront impunity and bring perpetrators of such violations to justice. The United Nations stands ready to assist the Government in this respect”.

In his response Mr. Rajapaksa noted that no UN official has the right to express their own views since Sri Lanka is an independent country. Official web site quoted him as saying, “We have confidence that our brave security personnel haven’t been involved in any misconduct… Our Forces are among the best disciplined Forces in the world… As a result of Fonseka’s statement our security officers are in danger. They could be taken into custody while they are abroad”.

At another news conference here Foreign Minister Rohitha Bogollagama charged that the UN Special Rapporteur on extrajudicial, summary or arbitrary executions has flouted diplomatic norms by making public the findings of a 3 member panel probing the controversial Channel 4 video even before Sri Lanka could respond to the revelations.

“My Ministry has communicated in this regard both to the Special Rapporteur as well as to the UN Secretariat in New York that the Public Statement in New York is a violation of all the accepted procedures of the United Nations and the norms of justice and fair play”, Minister Bogollagama told media.

The Foreign Minister charged that the Special Rapporteur had ignored the very findings of his experts in an attempt to influence the elections in Sri Lanka. “Therefore Prof. Alston’s rush and determination to go public, ignoring procedure and the very opinions of the ‘experts’ must make us question whether he is targeting our country and deliberately timing his actions to coincide with the current sensitive phase of national elections,” the Minister said.
